Products offered on www.gioieselli.it are provided for a fee.
Tariffs, duration and conditions applicable to the sale of these products are described below and in the respective sections of www.gioieselli.it.
Description of the product
Prices, descriptions and availability of the products are specified in the respective sections of www.gioieselli.it and are subject to change without notice.
Although the products on www.gioieselli.it are presented with the highest technically possible accuracy, the representation by photo, images, colors or any other means is to be understood as a mere reference and does not imply any guarantee regarding the characteristics of the product purchased.
The characteristics of the selected product will be specified during the purchase process.
Every phase, from the choice of the product to the forwarding of the order, is part of the procedure of purchase.
The purchase procedure includes the following steps:
Customers are asked to choose the desired product to make it appear in the purchase selection, indicating, where possible, the specific quantity and characteristics;
Customers may review their choice, modify, add or remove articles and, where applicable, provide specific instructions;
To access the checkout area, Customers must click the corresponding button;
Within the checkout area, Customers will be required in later steps to specify their contact details, billing and shipping address, and a means of shipping as well as a means of payment of their choice;
During the purchase process, Customers may, at any time, modify, correct or replace the information provided and add a gift card or discount code (voucher) or abandon the purchase procedure without any consequence;
After providing all the requested information, Customers are asked to carefully check the order and, subsequently, to confirm it and forward it using the relevant button or mechanism on www.gioieselli.it, accepting, in this way, the Terms, and committing to pay the agreed price.
Sending of the order
The sending of the order involves the following:
The sending of the order by the user determines the conclusion of the contract and imposes on the User the obligation to pay price, taxes and any additional charges and expenses, as specified in the order page;
If the purchased Product requests an active contribution from the User, such as the provision of information or personal data, specifications or special requests, forwarding the order constitutes also the User’s obligation to cooperate accordingly;
Once the order has been placed, a confirmation of receipt of the order will be sent to the Customers;
All notifications relating to the purchase procedure described above will be sent to the e-mail address provided by the User for this purpose.
During the purchase process and before placing the order, Customers are duly informed of all commissions, taxes and costs (including any shipping costs) that will be charged to them.
Means of payment
Details of the accepted means of payment are highlighted during the purchase process.
All payments are managed by third party services. Therefore, www.gioieselli.it does not collect payment data – such as credit card numbers – but receives a notification once the payment is successful.
If the payment made by one of the available means fails or is refused by the payment service provider, the Owner is not obliged to execute the order. Any costs or commissions arising from the payment failed or refused shall be borne by the User.
Retention of title
Until the Owner receives the payment of the full purchase price, the User does not acquire ownership of the Products ordered.
Contractual Right of Revocation
The Owner grants Customers the contractual right of revocation from the purchase contract according to the terms and conditions set out in the relevant “Returns and Refunds” section.
Deliveries are made to the address indicated by the User and in the manner indicated in the order summary.
At the time of delivery, Customers must verify the contents of the parcel and promptly report any anomalies to the contact details given in this document. Delivery may take place in the countries or territories specified in the relevant section of www.gioieselli.it.
Delivery times are indicated during the purchase process.
Failure to deliver
The Owner is not responsible in any way for any delivery errors arising from inaccuracies or omissions committed by the User in the completion of the purchase order, nor for any damages or delays that occurred after delivery to the courier if the latter has been commissioned by the User.
If the goods are not delivered or picked up at the time or within the time specified, they will be returned to the Owner, who will contact the User to schedule a second delivery attempt or agree on further measures.
Unless otherwise specified, any delivery attempt starting from the second will be at the User’s expense.
Rights of Customers
Right of withdrawal
Unless exceptions are provided for, the User may be entitled to terminate the contract within the period specified below (normally 14 days) for any reason and without justification. The User can find more information about the right of withdrawal in this section.
Exercise of the right of withdrawal
To exercise the right of withdrawal the User must send to the Owner an unambiguous notice of his intention to terminate the contract through email.
In order to respect the period within which the right must be exercised, the User must send the withdrawal declaration before it expires.
When does the withdrawal period expire?
In case of purchase of goods, the withdrawal period expires after 14 days from the day on which the User or a third party – appointed by him and other than the courier – takes possession of the goods.
In case of purchase of several goods ordered together but delivered separately, the withdrawal period expires after 14 days from the day on which the User or a third party – appointed by the User and other than the courier – takes possession of the last of the goods, lots or pieces.
Effects of the withdrawal
The Owner only reimburses the price of the goods, excluding the shipment price.
The refund is made without undue delay and in any case within 14 days from the day on which the Owner has been informed of the User’s decision to terminate the contract. Unless otherwise agreed with the User, the refund is made using the same means of payment used for the initial transaction.
The shipping costs of the return are borne by the User.
Legal Guarantee of Product Compliance
All products marketed by www.gioieselli.it are covered by a 24-month warranty for conformity defects. To take advantage of the warranty assistance, the Customer must keep the invoice/receipt that he will receive along with the goods purchased. The legal guarantee (two years from the date of delivery of the goods) can be advanced by the consumer within two months of the discovery of the defect.
The 24-month warranty shall apply to a product where there is a lack of conformity, provided that it is used correctly, in accordance with its intended use. Such guarantee, is reserved only to private customers (natural person who purchases the goods for purposes not related to his own professional activity, or makes the purchase without indicating in the order form a reference of VAT). In the event of lack of conformity, www.gioieselli.it will, at no cost to the Customer, restore the conformity of the product by repair/replacement or price reduction, until the termination of the contract. If, as a result of intervention by the seller, there is no lack of conformity, the Customer will be charged any verification, restoration and costs of carriage if incurred by the seller. In the event that, for any reason, the seller is unable to repair a product under warranty, he may, with the Customer’s consent, replace the product itself (if still listed) or with other of equal characteristics and value.
No damage may be required at www.gioieselli.it for any delays in making repairs or product replacements under warranty.
No implied waiver
The non-exercise by the Owner of the rights under the law or claims deriving from these Terms does not constitute a waiver of the same. No waiver can be considered definitive in relation to a specific right or any other right.
Interruption of the Service
To ensure the best possible level of service, the Owner reserves the right to discontinue the service for maintenance purposes, system updates or for any other modification, giving appropriate notice to customers.
Within the limits of the law, the Owner reserves the right to suspend or terminate the Service completely. In the event of termination of Service, the Owner will ensure that customers can extract their Personal Data and information in accordance with the law.
In addition, the Service may not be available for causes that escape reasonable control of the Owner, such as causes of force majeure (e.g. strikes, infrastructural malfunctions, blackouts etc.).
Customers are not allowed to reproduce, duplicate, copy, sell, resell or exploit www.gioieselli.it or the Service in whole or in part without the prior written consent of the Owner, expressed directly or through a legitimate reselling program.
Changes to the Terms
The Owner reserves the right to change the Terms at any time. In such a case, the Owner will inform the Customers accordingly.
Changes will affect the relationship between the Customer and the Owner only in the future.
The continued use of the Service implies the Customer’s acceptance of the updated Terms. If you do not wish to accept the changes, you must cease using the Service. The non-acceptance of the updated Terms could entail the right of each party to withdraw from the Agreement.
The exclusive competence to know any controversy deriving from or in connection with the Terms lies with the judge of the place where the Owner is established, as indicated in the relative section of this document.
Friendly Settlement of Disputes
Customers can report any disputes to the Owner, who will try to resolve them amicably.
Although the User’s right to bring an action in the event of a dispute concerning the use of www.gioieselli.it or the Service is not affected, Customers are kindly requested to contact the Owner at the addresses indicated in this document.
The customer may address his complaint to the e-mail address of the Data Controller indicated in this document, including a brief description and, if applicable, details of the order, purchase or account concerned.
The Data Controller will process the request without undue delay and within 21 days of its receipt.
Customers can report any disputes to the Owner, who will try to resolve them amicably. Although the right of Customers to bring an action in court remains unaffected, in the event of disputes concerning the use of www.gioieselli.it or the Service, Customers are asked to contact the Owner at the addresses indicated in this document. The User can address his complaint to the owner’s email address indicated in this document, including a brief description and, if applicable, the details of the order, purchase or account concerned. The Data Controller will process the request without undue delay and within 21 days of its receipt.
Dispute Settlement Platform with Consumers
The European Commission has introduced an online alternative dispute resolution platform that facilitates the out-of-court settlement of disputes related to and arising from online sales and service contracts.
Therefore, any European Consumer can use this platform to resolve any dispute arising from contracts concluded online. The platform is available here.
SHIPMENTS AND RETURNS
GioieSelli delivers all over the world.
Shipping in Italy is free for orders over 60 euros.
For the rest of the countries free shipping will be for orders over 200 euros.
Orders are processed and shipped Monday to Saturday morning.
We will use for deliveries in Italy the Italian Post Office service called Posta 1 or similar. Delivery times vary from 1 to 4 working days (Saturday and Sunday excluded). Shipping in Italy will be free for orders over 60 euros, for orders less the rate will be 6.50 euros.
For foreign countries we use instead the International priority mail service or similar. The delivery times will be different depending on the sending area:
In Europe, 4/5 working days (except Saturdays and Sundays);
In North America, 10 working days (except Saturdays and Sundays);
Rest of the World, 12 working days (except Saturday and Sunday).
Shipping will be free for orders over 200 euros.
Otherwise the rates will be divided according to the sending zones:
In Europe, euro 9;
In North America, 15 euros;
Rest of the World, 18 euros.
The moment the order is processed, the Customer will receive a tracking code of the shipment and the web address where to follow on line the status of the delivery.
GioieSelli will not be responsible for any delays due to fault of the courier.
Upon receipt of the goods, the Customer is invited to check:
– the package is intact, undamaged, wet or otherwise altered even when closed;
– in the case of damaged parcels, you must check that the goods are still intact and if there are anomalies communicate it promptly to Gioieselli by email.
Returns and refunds
For GioieSelli, customer satisfaction is the basis of everything.If for any reason you are not fully satisfied with the purchase, you can return the order free of charge within 14 days from the delivery date and receive the refund of the returned products.
Items returned must be in perfect condition without any indication of use and in their original packaging. To exercise the right of withdrawal the User must send to the Owner an unambiguous notice of his intention to terminate the contract through email.
The Owner only reimburses the price of the goods, excluding the shipment price.
Unless otherwise agreed with the User, the refund shall be made using the same means of payment used for the initial transaction.
GioieSelli will proceed to the relative refund to the cost of the goods shipped, within the terms of law (30 days), only after receiving the goods and checked that all the requirements have been met.
The refund cannot be made on cards other than those used for the purchase and cannot be made by bank transfer.
Reimbursement shall not include the cost of transport of the goods for subsequent refund.
The shipping costs of the return are borne by the User.
